The Chamber of Advisers adopted the majority on Tuesday in Rabat, Bill N ° 02.23 relating to civil procedure, in the presence of the Minister of Justice, Abdellatif Ouahbi. Lhe text collected 34 votes for, against three abstentions and no opposition. It is part of the dynamics of reform of the judicial system consistent with the Constitution and international conventions.
The Minister said that this project aims to strengthen the rights of litigants, improve the performance of the courts, and support the transition to digital justice. It also reflects the recommendations of the new development model by promoting more fluid access to justice and by shortening the processing deadlines for files.
Among the subjected background amendments are theit deletes provisions relating to fines to guarantee the right of access to justice, the revision of the rules of incompetence with the establishment of a separate judgment called, as well as the clarification of the mechanisms for the management of appeals and procedures by the magistrates. The role of the judge is reinforced without harming his neutrality, and the lawyer sees his consolidated place, including in oral procedures.
The parliamentary advisers welcomed a major reform, qualifying the text as an cornerstone of the judicial system. They highlighted its consistency with constitutional rights, its ability to solve the recurring problems of civil disputes and its central role in the transition to a digital court, a key element to build more accessible, rapid and efficient justice.
